Disiplin hukum secara sistematis terdiri dari ilmu hukum dogmatis, teori hukum, dan filsafat hukum. Fungsi teori hukum antara lain untuk menjembatani antara ilmu hukum dogmagtis dan filsafat hukum. Namun, bagi pengamat hukum, teori hukum juga menyediakan landasan teori untuk keperluan penyelidikan tentang berbagai isu di dalam studi hukum.
Buku ini ditulis dalam rangka membantu pembaca menyiapkan keperluan penelaahan teoretis tentang salah satu isu hukum, yakni tentang kecakapan bertindak di dalam hukum perkawinan. Dalam buku ini sengaja teori yang diulas bukan teori tentang perkawinan, melainkan teori-teori yang berada dalam ranah dasar (grand) dan menengah (middle range).
